    Text Robert Galbraith ___ to Abel Fisher

    This indenture made the ninth day of April in the year of our Lord one thousand seven hundred and seventy four between Robert Galbraith of the town of Bedford in the County of Bedford and Province of Pennsylvania Attorney at Law at Mary his wife of the our part and Abel Fisher of the County of Westmoreland and in the Province aforesaid yeoman of the other part: Where as John Procter Esquire late Sheriff of Bedford County by virtue of a certain Writ of Fieri Facias to him directed seized and took in execution a certain improvement plantation and tract of land situate on the Two Mile Run beyond Ligonier in the Township of Fairfield now in the County of Westmoreland late the property of Nathan Young and that the residue of the execution of the said writ appeared in a certain schedule or inquisition there unto annexed by which inquisition it was found that the rents issues and profits of the said improvement plantation & tract of land with the opportunances were not of a clear yearly value beyond all reprized sufficient with the space of seven years to satisfy the debt and damages in the said writ mentioned. Therefore in and by a writ of Venditioni Exponas listed at Bedford the seventeenth day of July in the year of our Lord one thousand seven hundred & seventy two to the said Sheriff of Bedford County directed he was commanded that the plantation and tract of land aforesaid situate lying & being as aforesaid with the opportunances he should expose to sale. And Where as the said Sheriff having given due & timely notice of the time and place of sale of the aforesaid tract of land with the opportunances exposed the same to public sale when Robert Galbraith of the town of Bedford Attorney at Law bought the same he being the highest bidder for the same as in and by the Sheriffs Deed to the said Robert Galbraith bearing date the sixteenth day of October one thousand seven hundred and seventy two reference being thereunto had may fully appear Now this Indenture Witnesseth that in consideration of the sum of thirty pounds lawful money of Pennsylvania to the aforesaid Robert Galbraith in hand paid by the aforesaid Abel Fisher the receipt whereof the said Robert Galbraith doth hereby acknowledge and thereof acquit & forever discharge the said Abel Fisher of his executors administrations and assigns by these presents hr the said Robert Galbraith and Mary his wife have granted bargained sold released & confirmed and by these presents do grant bargain sell release and confirm unto the aforesaid Abel Fisher and to his heirs and assigns all that the afs'd improvement plantation and tract of land situated on the Two Mile Run beyond Ligonier in the Township of Fairfield and County of Westmoreland aforesaid containing three hundred acres be the same more or less. Together with all and singular the hereditaments and opportunances thereunto belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof and also all the estate right title interest property claim and demand whatsoever of the aforesaid Robert Galbraith and Mary his wife of in and to the aforesaid tract of land and premises and every part thereof with the opportunances To have and to hold the aforesaid tract of land and premises hereby granted or mentioned or intended so to be with the opportunances unto the aforesaid Abel Fisher his heirs and assigns to the only use and behoof of the said Abel Fisher his heirs and assigns forever Subject to the payment of the purchase money interest and quit rent... and all of dues now due or hereafter to become due to the Honorable the Proprietaries of the Province of Pennsylvania their heirs & successors for the same. And the aforesaid Robert Galbraith for himself his heirs executors and administrators doth hereby covenant promise and grant to and with the said Abel Fisher his executors administrators and assigns by these presents that he the aforesaid Robert and his heirs the before mentioned tract of land and premises with the opportunances unto the said Abel Fisher his heirs and assigns from all persons lawfully claiming under him the said Robert and his heirs shall and will warrant and forever defend by these presents. In witness whereof the aforesaid parties to these presents have hereunto interchangeably set their hands and seals dated the day & year first above written.

    Westmoreland County ss: Be it remembered that on the third day of May in the year of our Lord one thousand seven hundred and seventy four before me Arthur St. Clair Esq one of his majesty's Justice of the Peace County (Page 25) County aforesaid personally appeared Robert Galbraith and Mary his wife the grantors within mentioned and acknowledged the within written indenture to be their act & deed and desired the same may be recorded as such the said Mary being of full age and secretly and apart be me examined she voluntarily consenting thereunto Witness my hand and seal the day & year aforesaid
